Data Use Policy – LEAP Surveys

Effective October 2, 2017

LEAP Innovations (“LEAP,” “we” or “us”) is committed to respecting the privacy of all users (“users,” “you” or “your”) who participate in our surveys (the “Services”). We have established and implemented this Data Use Policy (this “Policy”) to inform you of the information we collect from you in connection with the Services, how we collect and use your information, with whom and for what purposes we may share your information, and the choices you can make about our use of your information. By using the Services, you consent to the privacy practices described in this Policy. If you do not consent to these practices, do not use any of the Services and do not participate in any of our surveys.

In some cases, LEAP provides the Services directly or through a partner, and in other cases the schools and school districts that participate in our Services (each, a “Participating School”) or a third party acting on behalf of the Participating School provides the Services directly to you. If a Participating School or a third party acting on its behalf is providing the Services, then the Participating School is responsible for complying with this Policy. In that case, you agree that LEAP shall have no responsibility for the Participating School’s or third party’s actions, and you hereby release LEAP from any such responsibility, but LEAP still agrees to comply with its Policy in connection with the information that LEAP receives under this Policy.

For students participating in our Services, the Participating Schools (defined above) have the responsibility to obtain, and have assured LEAP that they have obtained, any necessary consent from a parent or guardian including providing any required disclosures to parents or guardians. We will gather information from students directly only as requested by a Participating School and only for the purposes of providing our Services to the Participating Schools.

Types of Information We Collect and How We Collect It

Personal Information. When we use the term “Personal Information” in this Data Use Policy, it means contact information (e.g., name, address, email address, mailing address, telephone number) and any other information that personally identifies an individual. We only collect Personal Information related to Participating School personnel that participate in the Services, and only a name and an email address for those people. Participating Schools provide the Personal Information to us.

We do not knowingly collect or ask for Personal Information from any students participating in the Services or from any person under the age of 13. If you are a student or are under the age of 13, please do not provide us with any Personal Information. If we learn that we have inadvertently collected Personal Information from a student or a minor under the age of 13 in connection with the Services, we will delete that information as soon as possible. If you believe that a student or a minor under the age of 13 has submitted Personal Information to us in connection with the Services, please contact us using the contact information listed below.

Survey Responses. We collect information that you provide in response to questions on the LEAP Surveys (“Survey Responses”). For Participating School personnel, those survey responses are associated with each person’s name and email address. For students, the survey responses are not connected to any Personal Information for that student. In some circumstances, the demographic information collected in connection with a specific student could be specific enough that an individual student could be identified, but we do not disclose individual survey responses (as described below) nor any individual demographic information.

Anonymous or Passive Information. We may also collect and store certain information that does not identify you, such as your Internet protocol address, browser type, domain names and access times (“Anonymous Information”). As you navigate, use, or otherwise interact with the Services, we may use automatic data collection technologies to collect certain information about your equipment and browsing actions, including without limitation: (i) information about your computer or mobile device and internet connection; (ii) details about your visit to the Services, including resources you use on the Services and other traffic, navigational, or communication data; and (iii) your geolocation information. We may also use Cookies (as defined below) and other tracking technologies to collect information about your online activities. “Cookies” are small pieces of information that a website sends to your browser while you are viewing a website. You can instruct your browser, by changing its options, to stop accepting Cookies or to prompt you before accepting a Cookie from the websites you visit. We do not track users across third party websites and therefore do not respond to Do Not Track signals. We may use your Anonymous Information to analyze usage patterns so that we may enhance the Services and improve our internal operations.

How We Use or Disclose Information

Personal Information. We use Personal Information that we have collected in order to create accounts for Participating School personnel. We may also use Personal Information to let Participating Schools know if a particular person has participated in a LEAP Survey if we reasonably believe that disclosing information regarding an individual’s participation would benefit that individual (e.g., if the Participating School is offering an incentive), but we will not provide your individual Survey Responses to a Participating School (except as described below).

We may also use your Personal Information to contact you if you opt-in to our mailing list. If you change your mind, you can opt out of receiving mailing list emails from us by sending your request to hello@www.leapinnovations.org or by opting out via the “opt out” link included in each email.

Survey Responses. We may provide Survey Responses to LEAP Survey participants, to Participating Schools, to school districts, and to nonprofit partners that are working with the Participating Schools. In each case, we disclose Survey Responses only to the individual who provided those Survey Responses or on an aggregated basis. For example, we may provide a summary of Survey Responses for an entire class to the teacher of that class, a summary of Survey Responses for a group of teachers to the administration of a Participating School, or a summary of Survey Responses for Participating Schools to a school district. LEAP will use its reasonable judgment in determining whether enough individuals have provided Survey Responses so that the summary information is less likely to identify any individual based on their response.

We may also analyze the Survey Responses for research purposes and to publish reports as we share insights with the education community. Any report that we publish will not include an individual’s Survey Responses and will only include analysis of aggregated Survey Responses. We may also use Survey Responses to help us improve the Services.

Anonymous or Passive Information. We may use or disclose Anonymous Information for any purpose including to improve the Services, to troubleshoot problems, and to analyze use of the Services.

In addition, we may use your Personal Information, Survey Responses, and Anonymous Information (collectively, the “Information”):

  • for internal development purposes to improve the Services;
  • for any purpose if you provide your consent;
  • in limited circumstances to share with research partners who have agreed to follow this Data Use Policy and where LEAP has received reasonable assurances that such research partner has any necessary authorizations to access the data.

Third Party Links

The Services may contain links to third parties’ websites. Please note that we are not responsible for the collection, use, maintenance, sharing, or disclosure of data and information by such third parties. If you provide information on third party sites, the privacy policy and terms of service on those sites are applicable. We encourage you to read the privacy policies of websites that you visit before submitting Personal Information.

 Other Information

We exercise reasonable security measures to help protect against the loss, misuse, and alteration of your Information. LEAP hosts its Services (or has a third party host its Services) and the collected data in an environment that uses reasonable technology to help prevent interference or access from unauthorized persons. Despite such efforts, however, please note that no company, including LEAP, can fully eliminate risks or guarantee the security of your Information; unauthorized entry or use, hardware or software failure, and other factors may compromise the security of information about you at any time. Consequently, we do not guarantee the security of any information you provide to LEAP through the Services.

This Data Use Policy is subject to revision from time to time on a going-forward basis. Please revisit this page periodically to remain aware of any changes to this Data Use Policy. We will post any revised version of this Data Use Policy on this page. If we make any material changes to it, we will make reasonable efforts to notify you of the change. For example, we may send a message to your email address, if we have one on file, or generate a pop-up or similar notification when you access the Services for the first time after such material changes are made. Continued use of the Services following notice of such changes will indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

The Services are operated in the State of Illinois, in the United States. If you are located in Canada, the European Union, or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using the Website or Services or providing us with your information, you consent to this transfer.
